Help

I have a situation where we have 2 students who are incontinent and need a room to get changed in if anything was to happen, where do we stand within the law, do we need to provide a separate changing or even a washing facility for them, as at present the hoist is used in the first aid room, and they are changed in the first aid room also.

can anyone help

Unfortunately can't help from the legal angle - but I would hope that any decent organisation respects the dignity of any such individual and provides suitable facilities (which it sounds to some extent that is what you are trying to do). Look at it from the other side of the fence - if it was you in that postion what would you reasonably expect. Also, irrespective of the dignity issues, the last thing you would want is to have the bad PR associated with not have duly respected them.

If incontinence falls within the terms of the Disability Discrimination Act, you must make 'reasonable adjustments'; is it reasonable to provide washing and changing facilities in your circumstances?

Hi paul

I want to provide facilities but need back up, is there anything that states in the act that we must provide these facilities if we accommodate the students, its something that i just dont know about.

If you have toilets designed for those with disabilities would these not suffice. There is both room to change and wash facilities.

They need a bed to be changed on, this is a request from them.. as i say i dont know alot about the regs.. i dont really want them using our first aid bed..

It sounds as if the 2 students have more disabilities than incontinence? Without knowing the full details it would be difficult for me to comment but as a first step I would look to use the existing FA Room, with possible adaptations. This would be quicker to achieve and may prove acceptable. If not I would progress to a more specific facility.

Have you got access to Occupational Health advice?- Again it might be possible to access funding (and an official statement of what is required) from Access to Work- part of the Job Centre- but they can only get involved if Occ. Health have been.
I would re-itterate what has been said before- the law requires you to do "what a reasonable Employer" would and if it is defined as a "disability" you might find yourselves prosecuted under the DDA (with the resultant publicity). On moral grounds too, what would you like the company to do if it was you!
