It was always going to be heavily watered down; it is here though, and it is a start, as with many regs/orders/bills, I look forward to the amendments.

A start I agree, and we all knew it would be watered down, but the lack of individual responsibility, in my opinion, waters down, not strengthens existing legislation.

What was wrong with prosecution under the HASAWA? Unless they are relying on the stigma associated with companies being tagged with 'manslaughter' I think it gives it gives companies an alternative and deflects the blame from individuals.

Surely the whole intention, when we all got exited about corporate manslaughter act, was making it easier to identify the controlling mind. Can't see how this helps?

The point of the Act is that there is now no need to identify a controlling mind in order to bring a prosecution against the company.

HASWA can still be used for individuals.

Going off on a tangent - is there anything on this IOAH website explaining what its all about? I've searched but not found. Ok there are discussion threads but nothing "official" A brief this is what its all about would have been handy?

Or did i miss it?

It may be premature for IOSH to publish guidance when The Department of Justice has indicated in its press release that guidance will be published in Autum 2007!
