Can anyone advise what regulation states that an evacuation list should be kept and what the penalties are for breaching the regulation?

Lucinda, I just noticed you have three postings, all related so here goes;

All operatives who arrive on site to carry out work should be induction trained before doing anything. The induction will include all site rules including no smoking and fire procedure.

As I mentioned in another of your postings the site register becomes a fire register once the alarm is raised and arrangements should be made for it to be removed to the assembly point in order for a roll call to be taken.

Whether there is legislation or not doesn't it all make sense?
