Posted By Bruce Sutherland Has any one got a better memory than me .... not a very hard challenge! What makes it even worse is that I thought that I had made this post on Monday and logged on today to find the answer... perhaps I need less medicine!
I seem to recall that someone blew up some tower blocks in the Midlands and left the artex in them and was prosecuted. But I can not remember who or when. Any clues?
This was before CAR and at the time was considered very very naughty

Posted By Bruce Sutherland oh come on don't fail me IOSH website - I think the answer is Controlled Demolition - but I also think that they may have been nicked for pressure washing the artex off not blowing the building with it in it - can any one please corroborate - I can not find it on hse site so probably too early for their on line records

Posted By Simon Carrier You are correct it was controlled demolition in 1999, however the tower blocks were in Dudley and not Birmingham. Try the HSE prosecutions database for details of breaches and fines.

I believe Controlled Demolition were prosecuted for pressure washing artex in two tower blocks in Dudley (Prohibition Notice issued Summer 1999 - fined about £15,000 for 4 breaches of CAWR 87). I can't remember any prosecution for explosive demolition of artex-containing buildings, although I believe the same company was involved (early 90's ish?) in a 'trial' blow-down in Leeds (?), where work was monitored by local HSE. The building had been prepared for implosion with the artex left in situ - local HSE got 'interested' and there was an amount of 'correspondence'. The job eventually proceeded as planned, and it is my understanding that no elevated airborne asbestos fibre levels were detected during the process. HSE stopped short of actually 'approving' the method but I know of no further action being taken.
I accept this is probably of limited help to you and may be somewhat anecdotal but .......
