welfare regulations construction - workplace

Posted By Merlin Just a quick one
If the Construction (Design and Management) Regulations 2007 has “revocation of Instruments” the construction health safety and welfare regulations 1996
Have the Workplace (Health, Safety and Welfare) Regulations 1992 any relevance to construction

Posted By Pete Longworth I may be wrong here but my understanding is that the Construction (Health Safety and Welfare) regs have been amalgamated into CDM 2007 and that is the reason they have been revoked. From that point of view the Workplace Regs wouldn't have any greater relevance to construction than they had previously.

Posted By Merlin Thanks Peter But I may have just answered my own question In the CDM reg 9-c The WHSW regs which relates to the design of, materials used in, the structure
But when looking through I cannot pin point where?

Posted By Pete Longworth Just looking through it may mean:
reg 6- ventilation, reg7 - temperature, reg 8 - lighting, reg 10 - room dimensions and space, reg 12 - condition of floors and traffic routes, reg 14 - Windows, transparent / translucent doors, gates and walls, reg 15 & 16 - windows and skylights, reg 17 - traffic routes, reg 18 - doors and gates.
I've got a checklist for assessing new workplaces that I can send you a copy of.

Posted By ken mosley Dear merlin,
The short answer is no. The Workplace regs have never applied to construction (see reg 3.1.b.). Including the the leftover bits of the Construction regs into CDM 2007, once the height working elements were removed, was just good legislative housekeeping.

Posted By Clarke Kent the 2nd As above welfare regs apply to the designer only who have to conider them throughout the design process if the finished product will be used as a workplace.
