The new roads and street works act 1991
At section 67-2 is states that there should be one person having a prescribed qualification as a trained operative.
I am told that from 1997 all operatives now require training
Also can any one throw light on section 50 license under this act as I cannot explain any more (to those that think they know better) than what I already have?

Posted By Robert K Lewis The seeming contradiction arises from the modular basis of the qualification. Certain modules are common while others are selected dependent on the precise tasks to be done. Therefore ALL operatives must have passed basic training while at least one of the gang must have also passed the relevant module for the task being undertaken.
Other than to say that it is a legal requirement to hold a licence from the Local Authority to carry out any work involving the opening up of the public highway, including the pavements and verges. Section 50 is the part of the act that specifies the need.

Posted By Merlin Thanks for the reply Bob, it roughly what I have been trying to get across to those that know better and have done the job man and boy without these rules and regulations and then the are amazed when they are told what is the correct way but carry on and then the highways come along and stop the job in Yorkshire as in most part we say you “cannot educate pork”

Posted By Robert K Lewis It is rather like a site recently where I overheard the following:
"We could close the footpath Saturday morning and quickly do the dig out to the sewer connection it is only 18 inches from the kerb edge. We can easily close half the road width. We are allowed to do it this way as it is short term work"
We had a discussion on the matter and the site agent seemed amazed that we could not close what he regarded as a quiet residential road for 4 hours.
Nuff said!
