I know there are transitional arrangements under Reg 47 of CDM07 for assessing the competence of Co-ordinators and PC's on jobs that were already under way prior to April 2007. Are there any similar duties/arrangements for assessing the competence of designers on a job that had already gone well past the initial design stage prior to April 2007 but will not start the construction work until December 2007. In short is there a duty to retrospectively assess the competency of designers who were appointed prior to April 2007 as well? Thanks in advance. All I am aiming to do is get the designer(s)to complete a questionnaire, (not a very complicated one I hasten to add), however I sense a certain reluctance.

In short IMO no. most of the original design demands under earlier CDM are retained and the obvious changes are as detailed in the ACoP.

The fact that everything is in place means that you have (I imagine) suitably assessed the design team and approved their use on this project for December. They will be working strictly to CDM 2007 on that basis with no allowance in place for any 'easy run in'. I would like to have satisfied myself that the design side of the project fully understands the principals of CDM 2007, aside from that I feel you would have little to be concerned about. If they don't have a clue whet those duties consist of then it may be time to start talking with them.
