Hi Folks,

The BRE (Better Regulation Executive) is carrying out a major consultation exercise with a view to significant revision of H&S law. I presume that IOSH will respond as a corporate body, but responses are as usual invited from any interested parties, so this is our chance as practising safety bods to get our say in. First thought was "why are the Building Research Establishment undertaking this review":-) Problem is I think they could have made a better hash of it than has been the case with this document. The text sounds tired and formulaic to me and I will have to think hard to respond to much of what is asked.

Can someone from HQ comment on if IOSH is going to formally respond.

On a slightly light hearted note, which reg or part reg would you like to see the back of?

For me its the stupid outdated DSE regs. Other than a few postural & repetitive issues (put in Manual handling)the whole thing is a waste of time & money.

As for which regs - DSE & Manual Handling combined, would IMHO make a lot of sense.

How about all the regs issued with a summary page (no more than 2 sides of A4) at the beginning in plain, easy to understand English - that would be of assistance to small businesses that cannot necessarily afford the services of a 'H&S consultant', and would also be of use to the local manager in a larger organisation.

I do not think the consultation is at all about a major review of Health and Safety law.

This review is considering how the health and safety regime affects small employers
and employers whose overall risk is relatively low.

Its objective is to find ways to make compliance easier for these organisations, improve health and safety outcomes for their employees, and maintain the confidence of the public in the health and safety system as a whole.

The call for evidence paper sets out some key issues and questions and invites interested parties to submit their views and evidence by
31 January 2008.

The terms of reference is on page 15 of the consultation document.

IOSH Technical Committee will be looking at this consultation and it will be added to the list of consultation docs on the website in due course, when Members will be welcome to submit comments to add to the formal IOSH comments. If you want to simply post on the Forum, I will also try to pick them up.

Has to be open as we cannot discuss technical issues on the members forum - see moderators decisions on this on other threads.

I have perused this overnight and still find little to inspire me. I will however make some personal responses. With regards to GWs offer I think after the SWMP consultation responses I will continue to give it a miss. Committee sifting of received responses to create a list of those that are most in tune with the committee can never reflect fully individual thoughts. It is an unfortunate fact of any committee based response. Personal thing only though. On the SWMP I submitted a copy of my reponses to Richard Jones for information and replied personally to the consultation.

I have already posted some comments and as Jay points out, this review is about how regulation affects SMEs.

I have considered that a review is needed for small businesses for a long time. The level of non-compliance by small companies is disturbing. Sure there is a cost associated with compliance, but it is much more than just that.
