Does the dismantling of racking in a warehouse come under CDM 2007 regs. The racking only needs to be dismantled and not erected

NO! This racking does not form an integral, permanent or semi-permanent part or feature of the building structure.Neither is the racking something which was or is to be used for the purposes of construction.

A dismantling of warehouse racking is no more construction work than the activity of a vehicle dismantler,or the removal or relocation of a lathe or milling machine in a factory.

This is not "construction work", nor is the racking a "structure" in the context of CDM legal definitions.

My logic follows these definitions

the removal of a structure or of any product or waste resulting from demolition or dismantling of a structure or from disassembly of prefabricated elements which immediately before such disassembly formed such a structure;

and

any building, timber, masonry, metal or reinforced concrete structure, railway line or siding, tramway line, dock, harbour, inland navigation, tunnel, shaft, bridge, viaduct, waterworks, reservoir, pipe or pipe-line, cable, aqueduct, sewer, sewage works, gasholder, road, airfield, sea defence works, river works, drainage works, earthworks, lagoon, dam, wall, caisson, mast, tower, pylon, underground tank, earth retaining structure or structure designed to preserve or alter any natural feature, fixed plant and any structure similar to the foregoing

The definitions are broad enough to cover this work in my opinion, especially when a cable is considered a structure. It is not about whether it is permanenet or not. It is likely though that the work is of minor duration and this simply means that things like planning, co-ordination and co-operation, competence need to be undertaken - just like all work should be. The part 4 requiremetns should not be particularly stressful if the work is managed properly and supervised.

Strongly disagree. To stretch definitions beyond their intended definitions is to add unnecessary bureaucracy.
CDM is not intended for the kind of work the poster described, which will most likely be carried out by in-house personnel anyway. At best I would define it as "works".

Don't see where you're coming from saying a cable is a structure? Yes if it is part of the National Grid perhaps, but within a building or structure a power cable is a fixed service as defined.

We're confusing the poster Bob.
