Some advice please
colleague had a accident on 21st and did not attend on 24th would this be reportable or not. Advice about rest days weekends are these included

Not enough info to give an answer Mike. Did this person attend work on the 22nd and 23rd or were these the weekend or rest days? Was the 24th the only day they were absent?

Reportable = more than 3 days absence (or inability to do normal job) not including the day of the accident but including weekends, rest days, holidays, etc. Absence does not have to be immediately following the accident (although this has been the subject of MUCH debate on here)

sorry not enough info . this colleague works nights had accident after 12 midnight on 21st but did not return the following shift also on the 21st followed by 2 rest days and failed to return on the 24th do they count night shift has one date because you can work 2 shifts on the same date

Assuming they did return on the 25th, I would not consider this to be a "three days plus" absence. I would not count the second shift on the 21st as the "second day", as presumably it went on into the 22nd?

Thus 21st = day of accident
22nd (second half of the next shift) = day one after the accident.
23rd (rest day) = day two after accident
24th (day absent) = day three after accident.
25th = day four after accident - this is the critical day, which IMHO determines whether the absence is reportable.

If I understand correctly what you are saying, it is reportable. The accident occured on the 21st, which is not counted as its the day of the accident, he was off work 22nd, 23rd, 24th, hence 3 lost days. The rest days count as work days. It is "avaliable for work", so if they had been normal working days would he have come in to work, in this case it looks like no, the shifts are irrelavent, it is days that are measured as there are some very complex shift patterns out there!

The way I have always worked with RIDDOR, is if it looks like it is borderline then report it, it is no big deal. Just give an accuarte description of the accident, and make it clear that you have identified where the failing is and you have an effective plan to prevent a re-occurance.

I have worked at establishements where we were having up to 10 RIDDORS a month, but the HSE knew we were doing everything we could to control and reduce it, hence worked with us.

It's "more than 3 days absence (or inability to do normal job) not including the day of the accident" before it's reportable, not 3 days absence.

I personally don't think it's in doubt if the individual did return on the 25th - it's not reportable.

Yes, you are correct, I was assuming that the nightshift on the 24th, ran over to the 25th, hence he was unable to work for over 72 consecutive hours. You are right in saying that the 25th is the key day, I think Mike is correct also by saying if you call the RIDDOR contact centre they are very pragmatic in their advice.

Colleague accident 2/3/07 completed shift followed by 2 days holiday and 2 rest days returns to work on 7/3/07 .

If the answer is yes, then there's no doubt - not reportable.

If the answer is no then it's a grey area as this is only an individual's opinion (I am assuming the person did not visit their doctor for an opinion?). If the individual says that they do not feel they were fit to work on the fourth day they were away then strictly speaking it is reportable. However I'm prepared to bet that most companies would not ask the question.....and would not report it.

This is similar to a person in a 9-5 job being injured on the Wednesday, absent Thursday, Friday and returning to work Monday. How many people here would ask them if they were fit to work on Sunday?
