Posted By Steve H When performing a fire risk assessment in licensed premises how in depth to we have to assess the upstairs accomodation if it is solely for the business owner ... is it a place of work or is it a domestic area. Should they ba linked on the alarm system , recorded in fire drills etc. Or should an assessment be done purely on moral grounds, or should the area be totally ignored, an option I believe is not an option, but is it??

Posted By Robert K Lewis For the purposes of the LPRA the fire assessment has to include anything which can impact public safety so you cannot separate the private accomodation from the premises as a whole.

These include: public houses; clubs; dance halls/schools; village halls; community centres; churches; other places of religious worship or study and associated premises; temporary structures and marquees/tents. You must take into account ‘relevant persons’ “relevant persons” means— (a) any person (including the responsible person) who is or may be lawfully on the premises; and (b) any person in the immediate vicinity of the premises who is at risk from a fire on the premises, but does not include a fire-fighter who is carrying out his duties in relation to a function of a fire and rescue authority under section 7, 8 or 9 of the Fire and Rescue Services Act 2004 (fire-fighting, road traffic accidents and other emergencies), other than in relation to a function under section 7(2)(d), 8(2)(d) or 9(3)(d) of that Act; Factors to take into account are: If there was a fire in the public area would be persons in the sleeping accomodation be able to escape safely, would they be alerted if there was a fire. Like wise for the persons in the public area, would they be alerted if there was a fire in the sleeping accomadation etc. Regards LJ
