Posted By David Matthew Can anyone confirm that if during the course of undertaking roadworks you have to shut a footpath that if you erect a sign telling people to use the other footpath that you then become liable if they get run over crossing.
Or is it just another of those urban myths?

The general requirement in these situations is to provide an adequate safe crossing point. This is often not well done and people are left to dodge the traffic as a direct consequence of the conduct of your organisation. Can you see the Section 3 duty appearing.
If you create an additional risk by your activities then you must manage it. Pedestrians do not cross roads unless they wish to or are forced to.
