An attempt to rebalance the bonkers problems that exist. Badly worded by the Telegraph, as usual with its editorial team, in an attempt to make it look like a conservative anti-H&S matter. After all isn't this what we have wanted for a long time.

I think you will find that this is more political hot air - the labour government are planning the Regulatory and Enforcement Sanctions Act {RESA} along with the setting up of the Better Regulation Office to action the findings of the Hampton Report.

The RESA only adds extra sanctions in that it provides for on the spot fines and orders ect. I believe that the conception that the RESB will reduce prosecutions is government spin. It will allow EHO's to utilise other forms of sanctions as noted above as well as the ones they already have which if i am not mistaken is extending their powers rather than curtailing them - therefore consigning the less/better regulation story to myth.

In my experience EHO,s are reluctant to use prohibition/improvement Notices and prosecution where companies are more than willing to act on issues found during inspections/investigations unless serious accidents have resulted, and always use them as a last resort so the adding of the other lesser sanctions is nonsense.

This i believe will encourage EHO's to give out lesser sanctions where they would have once done nothing because of the co-operation of the company. This will add further to the myth that we are over regulated.

I Cannot wait for the tories response as many of the legislative frameworks we work to are enshrined in European Legislation - is Mr Davis saying we will withdraw from Europe.

No less or more than the opportunism shown by Labour over the years since 1997!

Whatever politician is talking one is always aware that politics are central to the thinking at the time of statement. None is particularly worse than another. However the charge of opportunism has the taste of those labour politicians who wish they had thought of an idea first. Perhaps it is time that we abandoned comment on these sort of stories or we might be regarded as opportunistic.

There seems to a very strong political view for and against the party in both power and oposition. What needs to be remembered is polititions are oportunistic by nature, whatever gets you noticed will become the spin of the day, and forgotten tomorrow. The people who do most to get safety legislation progressed are the HSE and the civil servants who do the drafting. MPs only read and vote on proposals, they may start the system by making a suggestion but it is soon passed to the civil service to work out the details. Polititians are opportunistic by nature or very hard working without the need to gain publicity for a seemingly populare topic (for five minutes).
