Posted By KEVIN O'KANE Hi All, sorry to raise the old RIDDOR chestnuts.I have a part time member of staff, who has being injured at work..with her hours only one day lost. However if she was full time , the manager doubts if she would be fit to work, within 3 days ..does she report it under RIDDOR...me thinks yes , but need reassurance ..thanks in advance

Posted By Bryan Goldsmith 16052 I guess as we have to count a Saturday and Sunday if it falls within 3 days of the accident even if the IP would not normally work those days then the same would apply top part time. The relevant wording seems to be 'fit to carry out their normal work' and not whether they actually return to work. eg if they return next day but spend the next 3 on light duties it would still be reportable as an O3D.

Posted By ITK It matters not what the manager "thinks", was the IP unable to carry out their normal duties for more than 3 days (including days off). If so then RIDDOR.

Posted By Heather Collins If she was unfit for normal duties for more then three days (not including the day of the accident) then the accident is reportable regardless of what hours/days she actually works.

Posted By Paul Duell It's reportable. It's "fitness for normal duties" on those days, not "at work".

Posted By anon1234 Agree with previous posts - normal work hours is irrelevant - if the person would have been unable to resume normal duties had they been required to work after the over 3 day rule had been applied then the incident is reportable
