Thought this was interesting. A piece of case law on the side of voluntarily accepting risk and proving that sometimes no-one is to blame.

"Volenti non fit injuria" (to a willing person, no injury is done) Is a well established common law doctrine. Lots of info. via Google if you search the latin term.
