Hello all
We own a plot of land adjacent and accessible through our premises. My MD has allowed another company free use of the land to construct a large metal tank on this land. My question is what legislation would this come under, I have already thought of Occ Liability and maybe CDM if the project lasts longer than 30 days. As owners of the land what bwould we have to have in place.

A little further information, the structure being built is all prefabricated steelwork and will then be transported elsewhere.

Why not assign a temporary lease FOC if you wish stating required responsibilities, thus eliminating any involvement from yourselves?
Is this land part of your main works area or a redundant part fenced away from your main working site?

Thanks for the swift reply, the land is fenced off from our premises and can be locked. However access is gained by means of crossing our car park. The project so far has consited of ariculated lorries delivering large steel components and a tele-handler to offload these items. Would CDM cover the fabrication of this structure if it is to be transported elsewhere. Sorry what is FOC ?

all environmental law also applies with the 'Producer Pays' principal being in place
E.g. The job may go off without a hitch and the land will be vacated by the 'free' users
However the 'free' users left pools of oil, antifreeze etc that seeped into the land. Any clean up problem is then your companies!
Noting that drains and land can carry such products a long way e.g. onto somebody else's land etc
Get some sort of contract in place re env areas
