Posted By John Corr Dear All, I have been reviewing the archived threads for drivers and working hours (note I don't wish to start a new thread on this!). I came across a mention to the Working time directive and that it suggests that where driving hours exceeds 4 then the mandatory working day should not exceed 11. I'm putting together a driving policy and would like to include that info but can't find reference to it other than the old thread (by Robert K Lewis). Can someone point me in the right direction for a reference please. I've looked at the working time regulations but can't seem to find the info I need. Many thank, John

Posted By John Corr Dave/Mitch - thanks for your replies. I'm in a grey area, I think, as I work for a University and people drive to get to fieldwork sites (then undertake on-site work). Hopefully I can find something I can use as guidance from your replies to ensure people do not attempt to spend 12hr days in total working/driving!

Posted By Mitch John, The same goes for our guys who sometimes drive across Europe to sites, that is why we recommend (cannot supervise remotely) the EU hours to our employees. Mitch

Posted By Dave Wilson Sorry people getting mixed up the rules are for GOODS Vehicles you dont have to keep records but must comply with the drivers hours. For cars I dont know however in 2006 A warning to companies that they must start tracking the working hours of their drivers is being issued to car and light commercial vehicle fleets after the first successful UK health and safety prosecution of its type. The Produce Connection was fined £30,000 after one of its employees died when his vehicle drifted into the path of an oncoming lorry. He had worked 76 hours in the previous four days and chronic fatigue is believed to be a major factor. The prosecution is thought to be significant because it is the first time that a company has been fined in a case of this type where the accident occurred outside working hours.

Posted By Mitch Dave, And so it should have done. Outside 'normal working hours' is no defence if the company has allowed or even insisted employees drive after completing long hours of work. Mitch
