Help required. I didn't know where to start looking for the answer to this, and thought someone on this discussion forum may be able to help. If the company gives away an old piece of machinery to an individual, not a company. What duty of care or legal obligation might the company have?
Any help with an answer or direction to any legislation would be appreciated.

I would be very cautious with this. I recommend you read the following HSE press release:-

It's covered by section 6 of the HSWA. I beleive the fact that you are giving it away is immaterial. Statements such as "sold as seen", etc are worthless in this situation.

Thanks for the response. I don't think either of these apply because the equipment will not be used at work. However, we are being cautious.

If you are happy that the machine is in a safe enough condition to give away then do so, what's the problem?
