Can someone please direct me to any legislation or guidance on the situation regarding the wearing of seat belts where fitted on FLT's.

And further still, to my knowledge an FLT doesn't need a belt (since 2002) only if t he risk assessment for the task indicates the risks are negligible, ground smooth etc.
What I more so want to know is if an FLT has a seat belt, must it be worn.

i've had this arguments lots of times - if fitted - they must be worn.
PUWER reg 27 - provision of restraining systems if there is a chance of roll over and crushing.. look in the ACOP

FLT may have a belt but the driver does not always ahve to wear it. e.g. if driver is repeatedly getting in and out. The allowances re seat belts are better explained in HSE's MISC 241 document. For example it says:
"Where wearing a restraint is not required throughout premises then measures need to be in place to indicate where LT operators should wear their restraint. Signs may be displayed in the LT or at appropriate access points to the areas where operator restraint should be
worn. Also, operators should be instructed and
supervised on the wearing of seat restraints".

That's the one John. Seat belts generally have to be fitted but do not have to be worn in all cases.
John's referenced documentation explains it quite clearly.
This same old chestnut comes up time and time again but we still get different answers!

Yes these 'old chestnuts' keep us busy doing refresher 'awareness training' and issuing reminder bulletins etc etc., to clear up misunderstandings. Managers are the worst offenders; a forgetful operative will ask his supervisor an H&S question and the manager 'on his feet' will guess the answer and it's the wrong answer, and it goes round the site, undoing any training that was given before.
I'm currently going through a whole raft of awareness/training on FLTs for a big customer: on seat belts, public roads, lights, chains, thorough exams, checklists, driver health issues. I'll put it all in their policy, but will likely have to do it all again next year :o))

With regard to the ACOP
Eception 1 'the truck has a high degree of stability.... etc,
I implemented a 7 and 3 mph max speeds on certain trucks. Does this then come under the stability issue?
