Can anyone remind me:-

- that there was a 2m rule above which the regs applied
- when it changed (was it WAH regs 2005?)

Yes there was, via the old construction (HSW) regs. It vanished on the introduction of the WAHR, which repealed clause 6.

Incidentally the 2 m rule was for double guard rail and toe board but the regs still required all falls to be protected, regardless of height so at least a single guard rail. see reg 6(1) on the same link above.

WAH still has a 2 metre rule, only a different one applying to the duty to inspect!
Regulation 12(4)b:

(4) Without prejudice to paragraph (2), every employer shall ensure that a working platform—
(a) used for construction work; and
(b) from which a person could fall 2 metres or more,
is not used in any position unless it has been inspected in that position or, in the case of a mobile
working platform, inspected on the site, within the previous 7 days.

And other legislation still has the 2m rule for certain industries - see SI 1999 No. 2205 and the associated MSN Annex A part 10.
