Does anyone know of any reason why a 360 wheeled excavator cannot be used as lifting equipment.
A CPCS Appointed Person (lifting Operations)has completed a Risk Assessment and Lifting Plan and operatives briefed. The excavator and lifting accessory (the forks)have current thorough examination certification, the Operator and Slinger Signaller are both CPCS cardholders.
So is there any legal reason as to why this item of plant cannot be used as a forklift?

We run many excavators in our fleet none of which are to be used as a forklift.Reason being machines have no check valves fitted to prevent load falling under hose failure and machines are inspected under PUWER Regs. If used as a lifting appliance LOLER requirements apply.

See 'Guidance on lifting Operations in construction when using excavators' Ref SG001(3) published by Construction Plant-hire Association (CPA)

Colin,
The CPA site looks interesting but I'm going round in circles trying to navigate, even the 'Join' page doesn't tell one how to join, there's just a phone number at the foot of the page. Do I have to call them?

We are a civil engineering comnpany that operates a fleet of excavators which we regularly use as cranes, utilising different attachments such a pallet forks, chains, slings etc.
Our excavators (and any associated quick hitch devices) are subject to a thorough examination by our insurers every twelve months (in accordance with the LOLER Regs). Lifting accessories such as forks and slings ever six months.
Most excavators are usually fitted with hose burst valves and safe load indicators these days. I would contact your insurance company for further guidance if you are still unsure.
