I am an H & S Manager on a construction site.

We get visits from a consultant (employed by the client) who quotes Building regulations for stairs, ladders and escape routes for the standards that the construction site should comply too.

I have informed him that these regulations only apply to buildings that are built. Unfortunately i cannot find it in black and white within the regulations. Can anyone help me locate suitable documentation/evidence to support my argument.

Unfortunately I think he is right - I would have a look at Reg 3 & 4 before you go to town on him.

Would he not be better employed looking at your compliance with CDM than the building regs?

For designers the BR 200 are important as is the Workplace regulations. For the contractor the requirements relate only to the manner in which Building Work is carried out and is best seen in the defintion of such work in the interpretation section.

The Workplace Regulations often place higher standards than the BR and will now take precedence in designing for the final structure following the CDM07 requirements on designers. Typical examples will include such as minimum height of guardrails even in final buildings, BR is actually only 900mm, and the provision of kickboards at workarea and walkway edges where materials may fall.

I would ask for chapter and verse from this consultant.

No! IMPO this is forked tongue nonsense. HSWA/CDM/RRFSO/WAH,etc all take precedence regarding working practices in construction.

This is on the assumption he/she is making reference to your working practices and not with regard the step-by-step construction of the building.

I am no expert on building works but if I am reading your posting correctly is the consultant suggesting that building regulations apply during the build process and not to the finished product as it were?

If that were truly the case I don't see how you would ever get above the 1st story as you would need to build building regulation compliant stairs etc which is ludicrous.

I would have thought CDM and the other safety legislation would take president during the build.
