The company that I work for wants to purchase numerous fluorescent light bulbs. One company wants to add an additional charge onto the cost of the bulbs under the WEEE Regulations. Neither the provider our our company will be disposing of the bulbs at the end of their life cycle.

Can someone explain to me why we are being charged under the WEEE Regs from a supply company?

Or are they trying to make extra income?

Interesting one.

Firstly, what are you going to do with the bulbs once replaced? If your giving them to the supplier, then it is he who has to dispose of the waste (or recycle), which can be chargeable. Therefore, as they are providing a service, they have included subsequent disposal/recycling costs in their charges to you.

One word of caution, you have a duty of care to produce a controlled waste transfer note covering the movement of said bulbs. This is your duty!!

From what I can remember of the WEE regs, electrical goods need to be properly disposed of and the duty can be carried out by the supplier, who can presumably add a charge for this service. Suggest you need to confirm that the supplier will dispose of used tubes and what arrangements they have for collection.

Have recently attended an IOSH Managing the Environment course where the tutor indicated that it is perfectly legitimate to return items such as used florescent tubes back to the supplier, and you should not be charged anything for doing so.

We will be installing them in new build projects and then the new builds will be given to our client. The client will be the one responsible for the disposal of the bulbs.

At no time will my company be disposing of any bulbs.

Ahhhh I understand now. It's a bit of a toughie and something I would negotiate with your supplier; perhaps with a view to them obtaining contracts for disposal from the new owners of the properties at a later date??? Either that or I would be changing my supplier. Many have jumped on the WEEE bandwagon for the wrong reasons!

SHE, surely this would form part of the site waste management plan? Presume you are a contractor on site, re-fabricating building, to which you are now in the completion stage and moving on to handover.

If you are replacing the tubes, then you are generating the 'spares' so to speak, so would see it as your responsibility to recycle.
