L108 guidance on controlling noise at work at work(page 120 para 38) states that where a visiting service provides noise health surveillance testing, the results should be kept by the employer. However a HSE inspector has told me that test results should only be kept with an occupation health department within the organisation. As my clients do not have occ health departments I have been told that the test results must be retained by me. Only amended health records with details of any action taken should be given to the employer. I been on the Internet to see what other providers are doing and many are saying that they provide all test results to the employer. Does anyone know who is right?

My company contracts out the Occ. Health surveillance, including audiometry.

The OH company retain all the records, we only get to see a summary.

Are we looking at Occ Health or dose monitoring under the Noise at Work Regs? The 2 are totally different and treated in contrasting ways too.

Occ health is audiometric testing, whilst dose meters can be 'personal' or 'static' and provide levels of attenuation, peaks etc. during a prolonged period (usually about 4 hours) giving a more rounded view of the noise levels employees are subject to. Reports should be supported by site plans and locations, sources of noise etc.

The reason for inspector’s suggestion was purely because all the surveillance records containing confidential information should be kept in confidence by the organisation’s occupational health service.
Bearing in mind that a lot of small originations do not have such facility, the records should be kept by the person carrying out the health surveillance. (Which of course would be occupational health officer). However, as an employer, you can obtain and keep the records which do not contain unnecessary confidential personal details. You may find this reference in L101.
