Posted By Raymond Rapp Shaun It's been a long time in coming. Disappointed but not surprised the CPS have chose to prosecute a small company. This is not what the CMA was designed for, but rather to prosecute large organisations. The proposed maximum fine by SAP is 10 percent of turnover, which for this company represents a mere £33,000. Still, some would see this a start and hopefully a precursor for other larger organisations to follow. Ray

Posted By Tabs Ray, "a mere" is probably the wrong term - it is 10%. That has the same meaning for this company as 10% would have on BP. Remember this is the punitive fine, not compensation or award. It is the compensation or award that should reflect the 'cost of life' element. If that was £33k I would certainly join you in the use of "a mere" though. A percentile fine was intended to make BP feel the same pain as this small company.

Posted By Raymond Rapp Tabs I take your point, but 'mere' reflects no just the fact that in a Crown Court an unlimited fine can be imposed, but also taking into account the severity of the offence.
