Hello folks - need a real quick answer to this as boss goes on holiday tomorrow - so here's hoping;)
I left my employment yesterday after giving - and working my contracted 28 days notice.
My salary date is normally the 28th of the month, but I reckon that, as I am no longer under contract, I am owed my wages and holiday pay accrued now - my boss states 28th as per contract. But I am no longer under contract or employed by them.
Can anyone advise please??
Many thanks
Dave

I agree with you, Dave, but you might be better posting on an HR forum.

Many thanks for your help Paul - much appreciated.
I was ready to give up on my search - but found my answer eventually - see link below.

And the employer CAN withhold till normal pay day.
Again - many thanks for your help.

Quickly then - and for anyone else interested. It is subject to what signed agreement is in pace DURING the - employment which dictates terminal pay terms conditions/dates etc.
Agree with Paul, it is HR not H&S. It's a Saturday though and the mods might not be so strict.

Thanks CFT for your input - always appreciated.
I agree totally that it is HR, but I was very short of time, and the bad ending that I had just made this the icing on the cake.
There was nothing in my contract stating the rules of this situation, and what I was asking was the fact I was out of contract anyway.
I await to see what else they try to get one over on me. They are very bitter people and I have followed my resignation requirements to the letter.
Many thanks guys.

Hi Dave.
Another HR website that is also very good for answering questions such as this is www.HRzone.co.uk.
Your pay must also include all overtime, commission, if owed and holiday pay up to and including the day of termination. Your employer does have the right to pay you at the normal payroll run and as you have given plenty of notice he should have your P45 ready for collection too at the same time.
In the event that there are any descrepancies, you must raise these in writing detailing the errors, head the letter: "Formal Grievance" - i would always send these letters by recorded delivery. If they dont acknowledge the letter or correct them quickly - you can then proceed to an Employment tribunal by raising an ET1 as this is known as Unlawful deduction of wages.Your terms and conditions should detail the procedure and it is important this procedure is stuck too.
Good Luck
Rose
