Health Surveillance 9. —(1) If the risk assessment indicates that there is a risk to the health of his employees who are, or are liable to be, exposed to noise, the employer shall ensure that such employees are placed under suitable health surveillance, which shall include testing of their hearing. My question is that after an assessment has been carried out - hearing protection has been provided (the only viable control measure), so does health surveillance (hearing test) still have to be done now that the risk has been reduced via control measures? Posted By Coshh Assessor Look at it this way - it would be a little strange to do the opposite and say "there is a risk to hearing, and we aren't going to provide protection, so we will do surveillance instead". The surveillance isn't an alternative, it's as well as control measures.

You have hearing protection zone..everything you can do you are doing.. u don't check.. down the line up comes an employee hearing has gone.. claiming u for breach of duty of care.. how can you evidence that it wasn't down to you if you haven't checked/monitored for years. 2nd scenario. you check regularly..1 employee hearing seems to deteriorating.. You look into this and find he or she DJ's 3 times a week in a local club.. Thus you can never be held to account for the hearing loss. hope this helps Cheers

Posted By John Richards Scenario 3: You lie through your teeth when the claim comes-in and say the guy/gal never did any such work, not ever: never. You fiddle the noise test/s so that the measured noise is lower than the threshold. Testing for noise after the unit has shut for the day is good, the same for fumes/dust etc....
