Posted By tim.preston I realise that it is not in line with the IOSH discussion forum protocol to name and same either individuals and/or organisations which are not operating with competent people. If this is not possible then how is one suppose to communicate to it's peers on which indivduals and/or orgnaisations to avoid. What do my collective peer professionals think of this dilemma?

Posted By tim.preston Gents, Let me clear...and no longer beat around the bush. There is a consultancy I used to work for who had a Technical Director who stated he was a member of IOSH...he wasn't...I had mu suspicions when he did have a clue about PQQ, pre tender, tender and the OJEU process. We did report him to IOSH and APS but the latter would not take it forward since they do not have the same clought as IOSH. Subsequently I left the company....then I hear on the grapevine that he has managed to take on another 2 IOSH professionals and after a period of weeks I heard that one of the guys hated it. In this economic downturn you need to know if you are going to get paid and I would not want to see anyone else experience the crap that I did. Know I'm working for a global consutancy in London and luckily they paid for relocation but it could have been so different.

Posted By martinw Consumer Protection and Unfair Trading Regulations 2008(P 21, s.6.1.1): the following is prohibited - (1) Claiming to be a signatory to a code of conduct when the trader is not. (2) Displaying a trust mark, quality mark or equivalent without having obtained the necessary authorisation. (3) Claiming that a code of conduct has an endorsement from a public or other body which it does not have. And maximum penalties? £5000 and or 2 years. Call the OFT and let them play. Martin

Posted By tim.preston Thanks for the advice and I will take it onboard. It has taken me up until know to even get to write about it on the forum (8 months later). I know we all value the time and effort we have put into getting where we are CMIOSH etc..yawn, yawn. However, it seriously ticks me off when people and companies give the perception that they are something that they are not, i.e. qualified, competent and importantly honest. As H&S professionals we are supposed to assist in getting the job done in the most simple, practical way (obviously taking acount of reasonably practicable) not create additional risk with inadequate fools claiming that they are CMIOSH, MaPS etc. etc. Anyway I think my experience and advice is ALWAYS DO YOUR DUE DILIGENCE ON THE COMPANY YOU INTEND WORKING FOR.

Posted By Swis Although claiming to be something which one’s not is very unethical, however couple of things needs to be clear here. 1) being a member of IOSH doesn’t always mean that you are a competent person. 2) I can’t see any logic in NOT accepting a post in company who’s director is not a member of IOSH. 3) Evaluation process would fall in customers remits. 4) How would it affect your employment if your director is not competent. 5) You must give credit to the director that at least he hires people who are competent regardless if he himself is a competent or not.

Posted By Ron Hunter I know a great many professional people (including several IOSH Members)who wouldn't have a clue about PQQs or OJEU tendering processes. That doesn't make them incompetent though. That said, I have come across people falsely claiming to have H&S Qualifications - but it is fairly easy for an employer/Client to check!
