Posted By AJM Hi Friends, I would just like to gauge opinion regarding a clarification on CDM Notifiable. Scenario; A job is to be completed for 25 commercial properties, the works are painting and decorating with minor joinery like skirting etc typically all low to medium risk. It will involve up to 10 men sometimes working on the same property for 5 weekends, (So bare in mind the works are completed only at weekends not in the week) Other properties will only be 2 weeks then moving onto a different property, all the properties are for the same client, the whole works to complete the 25 properties will take 4 month (Weekends only) Obviously working it out per property and worst case scenario it is nowhere near notifiable but for the whole properties to be completed it would go into notifiable if that is the way it is calculated. So basiacally what i am asking is, does the calculation for notfiable refer to the works being per property or the whole 25 properties and if it is notifiable does it make a difference if the properties are signed off and completed and paid for by the client after every property is completed? Posted By Robert K Lewis Back to the contract - do you have a single contract for all 25 properties if so then the answer is yes - notify. If there is 25 individual contracts then no do not notify providing the start date and end date fall within 30 days of each other. In reality I cannot see where all these notify or not problems arise from. It is rather like the angst expressed over the phrase "on behalf of". It is as if the regulations are creating new legal situations or notification is a major issue. All construction work must be properly planned whether notified or not and all need file information at the end of the project no matter what the size of the work. Bob

Posted By Ron Hunter I believe the spirit of CDM intends that "Projects" are to be centered around "Hub" issues such as welfare, management arrangements, risks arising etc.and that discretion and a bit of common sense can be applied Two questions then: (a) Would applying Notification to this Project add any real additional value in terms of managing risks? (b) conversely, is there a risk of important information being missed or perhaps obscured by rolling all these Properties into one overarching Project, Plan, etc.? (perhaps one or more of the Properties has particular issues with asbestos, fragile surfaces and the like?) Your Contract is IMHO a bit different from the typical (say) Local Authority Housing refurb Program involving 10s if not 100s of Properties. These then tend to be split and Notified by geographic location and centered on the temporary management accomodation and welfare provisions intended to be set up at the start of the Construction Phase Plan. Hope this makes sense AJM!

Posted By AJM Thank you thus far, Robert, Yes they are individual contracts for individual properties with each one being paid for after job completion and yes everything handed over including safety file and 0&M file to the individual site. They are however all running concurrent so as one property is completed they move onto next. It isn't really a problem and i am NOT looking for a way out of notifying. All i am trying to do is understand it better. All work is being planned and files accordingly etc with regular meetings between all parties. Ron, Yes, and thanks for the constructive reply, I don't believe Notifying would add any value in terms of risk management with a project like this, but obviously notifying means extra parts of the regulations apply. All sites are being completed 2 at a time and a dedicated project manager will be there for the duration of works. All things like Asbestos surveys and plans are available for each site. The welfare issues are not a problem as these are all buildings with running water and toilets etc and very clean. It would make common sense to just manage it as we are and the notifying is a side issue, but i like to leave no stone unturned as they say. Thanks Again, Alan
