If asbestos removal work is notifible under the 2006 regs is it notifiable under CDM 2007 if it is going to be over the notifiable period.

See the back page of an ASB5 on HSE website.
If asbestos removal is part of overall construction work then CDM would apply anyway.
If asbestos removal is being completed in a LA enforced area AND none of the work is outside then the LA are the enforcing authority, unless it is part of a CDM project.
Its a funny one as if ALL ASBESTOS REMOVAL was classed as "construction work" then the HSE would be the enforcing authority for ALL OF IT! ans they do not want that.
That's my take on it, but as always when aking the question we get 'its up to the Contrcatot to decide who the enforcing authority is?

Agree with DW - the HSE do regard the ASB5 as equivalent to an F10 if it is purely removal not related to other construction work, even when the CDM timings are exceeded.
