Posted By Crim Just contacted the Bristol Crown Court for an update on last week's case. The charge relates to the death of Alexander Wright, 27, from Cheltenham, who was gathering soil samples in a trench when it collapsed and killed him in Stroud last September. Peter Eaton, the sole director of the company faces a second, similar charge of killing by gross negligence on the same date, under common law. Eaton and his company also face one health and safety charge each, in relation to the same incident. There will be a Not Guilty plea in October with 4 week hearing in February 2010. The case will be contested.

Posted By Paul I Clark I went to this hearing last week as an interested safety professional and the judiciary are being careful with this being the first under the Act. A circuit judge will be assigned. After attending and reading above, this and the ‘other/ same’ court cases could become quite confused.
