We have a scaffolder erecting a relatively small scaffold. The scaffolder is trained to advanced level. The scaffolder is being assisted by a general labourer. The labourer is handing scaffold tubes, clips, etc to the scaffolder as the scaffold is being erected. It has been made perfectly clear to the labourer that he is not permitted to access the scaffold.

Our Client is insisting that what we are doing is illegal and the scaffolder can only be assisted by a trainee scaffolder?

Any views or advice would be greatly received.

I've sent you an e-mail regarding this, but what your doing is fine. Your client could refuse access to site for not having a CSCS / CISRS card if that is their standard, but basic labouring operations such as these are covered by the CSCS site operative card or CISRS scaffolding labourer card.
