Not in my field day to day, but I expect there would likely require strict precautions and minimum occupancy levels for such a survey to be carried out?

A type 3 survey is generally undertaken when intrusive work is likely such as demolition or alterations to premises.
if the assesor / surveyor is accordingly qualified and takes samples in accordance with mdshs 100 then there should be no problems for persons present as the sampling will be done so as not to expose themselves or others.

One the industries biggest concerns is that not everything is being found in most type 3's or survey companies have putting so many caveats that it is a worthless document.
I cannot put my finger on the exact item you are looking for (as I dont have it in front of me) but the new MDHS100 apparently has some wording on the issue.
I believe that the issue of carrying out type 3 surveys (or renovation/demolition surveys as they will be called soon) is not the fact that someone may become containated during the survey but more the fact that the level of intrusion required to undertake a full and proper type 3 would mean that there wont be a lot of walls of ceilings left by the time you finish.
Have a quick google of the new MDHS100 draft document and that should point you in the right direction.

MDHS 100 [2001] is the current principal source for your info Natalie.
However, you should be aware that it is proposed that the current three types of inspection/surveys will be replaced by two in the proposed new version of MDHS 100 - titled "The Survey Guide" - that will be a closer match to the requirements of the current version of the asbestos legislation [CAW 2006].
The new surveys will be focussed far more on the requirements of Reg 4 and will be called "Management" & "Refurb/Demo" Surveys.
It's supposed to be out about now, but it hasn't appeared yet.

Sorry Ron, I am not a HSE professional so I come in and out the forums looking at answering questions regarding asbestos (as that is what I do)
The original post was asking why a type 3 survey has to be done in a premises when it is not occupied. It didnt actually contest the reason to do the survey.
How does Reg 3 address this (or am I totally lost here and going down a different route)
This is by no means a vindicative reply, I am generally curious as I cannot mary the two up and would appreciate being put in teh right direction.

Thank you to everyone for your responses. Just to clarify we are moving out of our rented offices soon and the landlord wanted to do a type 3 survey to go out to tender for a demolition quote while we were still in occupation (obviously not while we were working) they would complete it over a series of weekends and then give us clean air or reoccupation certs. My concern is that they can not guarantee disturbing asbestos and contaminating the offices. As landlords they have the right of entry following reasonable notice and I was looking for a way to put them off.

There is no reason why the landlord can't do as he's stated, IF the job is very well managed and monitored.
No other people should be present during the survey, but as long as the survey works are monitored, the area cleaned afterward and areas where asbestos has been located correctly sealed there shouldn't be a problem.
We sometimes have to carry out Type 3's in occupied buildings, as the refurb works have to commence immediately upon decant. The surveys are carried out during the weekend, with lots of air testing at various stages, together with an asbestos contractor in attendance to clean up and make good.
The key question is do you trust your landlord to carry out the works properly?

You have a duty to protect others = occupants.
The type 3 survey is intrusive and destructive and the likelihood of discovery and disturbance of friable fibres is significant. There being no practicable means to protect the occupants in that circumstance, they must be excluded from the rooms or areas being surveyed. HASAWA Sectn 2&3, Reg3 of MHSWR, ERIC.
I would take issue with any Risk Assessment for Type 3 which did not conclude thus.
