As most of you will know the recording of assessments and a written H&S policy etc etc normally kick-in when employing 5 or more employees. My question; would the owner of a "Limited" company, employing 4 employees only, be required to have a written H&S policy and record significant findings of risk assessment. I'm not sure if the owner of a "Limited" company is considered an employee.

The owner or MD presumably pays his own national insurance as well as his employees and therefore I would say he is an employee = 5. Anyway, 4 or 5 employees it is a matter of good practice to have a h&s policy. And what happens when someone else joins and makes 5?

Sureley if the owner or MD takes some sort of income from the company, and has a say..directing mind of how the company produces that income... then are they not deemed as employees?

please check this site as the subject was discussed recently
I feel that the 5 persons situation would not allow you an adequate defence in many cases so I would disregard it and have adequate systems etc in place for all areas - its not a hard thing to do noting that the tax forms are more difficult to complete!

Ltd company is a legal entity and the MD is its employee if he/she does anything within taht company and takes benefit such as salary.

Thanks for the response everyone. I think as a limited company the MD/owner is an employee and as such should be counted; no matter how many years in this profession there is always a question for which you are not sure of an answer.
