A healthcare worker has been informed that they must have the swine flu (H1N1) vaccination. If they fail to comply and subsequently contract the virus, they have been informed that their pay will be either reduced or not paid at all, if off sick as a result. Is this legal? I have my own opinions from an occupational health and risk assessment perspective plus there are some employment law implications, but I would be grateful for a general consensus.

If they are contractually entitled to sick pay, then they are contractually entitled to sick pay. Variation of contract requires a consultation. All sounds well dodgy to me,

Sounds ridiculous to me, good to see that freedom of choice is live and kicking. Personally, I am entitled to the jab but won't be taking it either. I take the seasonal flu jab each year because I believe it has had the necessary research and testing to make it 'safe'. This new version has been rushed through in my opinion and I don't intend to be a free guinea pig for the government. I imagine the policy being taken by the healthcare worker's employers is an infringement on human rights?

It ceratainly sounds like a severe infringement of human rights, but I would urge everybody to have the vaccine and not believe the scare stories put about by the man in the pub (aka journalists). The vaccine is safer than the disease, by a long chalk,
