I see in another topic somebody has suggested the "NEEC" has been dropped, if so does this mean that cost should be no object or obstacle in the quest for health and safety?

I was refering to BAT in Environmental terms and as I asked if I am out of date can somebody up date me/us?

This comes from the 1992 EPA which to my knowledge hasn't been amended.
If anyone knows otherwise though...

This SEPA document "PPCSGN3 –Determining BAT for Part B Activities." (as an example) confirms that BAT has superseded BATNEEC, and then goes on to suggest that they are (in practical terms) one and the same.

"Best Available Techniques (BAT) are required to be considered (under EC Directive 96/61) in order to avoid or reduce emissions resulting from certain installations and to reduce the impact on the environment as a whole. Use of BAT is required by us when licensing the major potentially polluting industries under the IPPC legislative regime. BAT takes into account the balance between the costs and environmental benefits"
Nothing at all to do with H&S. We have, or did have, our reasonably practicable

So - are you saying that certain emissions into the atmosphere relating to dangerous substances is no longer health and safety?

Section 5 of HASAWA was repealed by Environmental Protection Act 1990, about 20 year ago.
