Hi all, I have recently joined a medium sized agricultural company. Part of my role is to undertake health & safety checks and management across its 40 plus farm sites. Naturally, these sites are regarded as workplaces for the purpose of H&S but many of them also contain a domestic family dwelling occupied by the managers and their families. In effect, my company acts as Landlord to these tennants and it therefore undertakes the usual checks and maintenance expected of it. However, as the properties are officially sited upon company premises, are such dwellings also regarded as workplaces under the Management Regulations? Does anyone have experience of such matters and/or can anyone offer asvice please?

Kevin, I am also in Norfolk! I assume you mean that they are 'tied' dwellings, and while I suppose it does depend on the individual circumstances, I would suggest that in the main that they are unlikely to be a workplace as defined under the workplace regs. I would have thought that in the grand scheme, there are plenty of other risks on a 'farm' that deserve your attention. There are of course other duties owed in respect of the dwellings, but my feeling would be not normally a workplace, unless specific circumstances suggest otherwise.

Ken, I would side with Phil regarding the tied dwellings. If your business acts as landlord you have differing responsibilities to commercial... have a look at: http://www.businesslink....61057&type=RESOURCES
