One of the contractor's driver met with a freak accident while driving in the workplace. The doctor's declared that he had an existing condition of T1 diabetics and hypertension, that had led to his disorientation while driving and resulted in an accident. He has been given 4 days rest from work. Cant this be classified as a LTI? There is a lot of argument that this cant be an LTI , coz it happened because of his existing condition which was not declared by him or neither it was diagonosed by the contractor. Any help!

There was an accident at work - there has been lost time. Yes it is an LTI. Now, had the individual collapsed because of the illness it would not be an LTI because there was no incident. My view only! Colin PS - I am surprised that the diabetes has been classed as Type 1, these are normally diagnosed as children. The old name for Type 2 was "adult onset diabetes" which, on the face of it, may be more likely.
