can any one advice me? we have recently taken over a contract that the previous contractor and contract managment team have been removed from site !The site, a conversion of a non domestic building has had a prohabition notice , from HSE served for various issues . one particular issue is "the lack of an asbestos survey". i can see clearly the inspectors point of view as the survey could have identifed any ACM prior to demolition. the interior of the building has been completly stripped out . i ask: 1. How can an asbestos survey be carried out on an empty shell. 2. is the client, (also being the duty holder) looking at possible prosecution for falure to carry out the survey, prior to works being carried out? your comments would be appreciated. David I think your best approach will be to talk to the issuing inspector to see how s/he would wish this taken forwards. S/He could certainly be looking to the client for assistance in l;ocating where materials were tipped but a prosecution on the client does not appear to be in her/his mind. Remember once you take control of a premise by virtue of a contract you as contractor now carry the duty to manage not the client/building owner. Bob

That's "premises", Bob. The noun is always used in the plural when describing land/property/structures. A 'premise' is something entirely different. (Sorry, pet hate). As far as the Site goes, it would be prudent to get some dust samples and air analysis undertaken - unless of course the structure has been essentially open to the elements for a protracted period? You also need clarification of what activities are prohibited, and why.

Ron Even premises can be tricky as it too can have other meanings - some grammar primers allow for both uses and merely change the inflective tone to distinguish the meaning intended LOL Bob

David, I once surveyed a property in similar circimstances - an 18 storey tower block in London had been completely soft stripped without prior survey or controlled removal taking place. I found widespread asbestos debris on every floor and in virtually every room. As far as I can recall (it was a few years back now) no indivudal piece was bigger than a 10p coin, but cumulatively it added up to quite a bit. Do advise your surveyor of the full story, so they know they're looking for dust & debris in a possibly contaminated area.

thanks chris, we have instructed an accredited surveyor to take air, dust and wipe sample. Looks like the client is going to face procecution though as the HSE inspector is coming down hard .
