Hi All,

Trying to complete a document and having "one of those" days!...

What specific section of HASAWA applies to Sub-Contractors including sub section?

Section 4(2) applies if you are the duty holder for a site with contractors coming on to your site. Generally speaking to provide a safe site (access/egress etc) for the contractors coming on to the site.

I'd say the usual Section 2(1) and 2(2) apply to the subcontracting company working on behalf of the duty holder in terms of protecting "those affected" by their work.

Section 7, item a would be the sub-contractors employees on the ground taking reasonable care for the health and safety of other persons who may be affected by their acts or omissions.

Posted too soon and lack of an edit function! Apologies for quoting all three areas which I feel are applicable as I am unsure which angle you are coming at this from.

Also Section 3 covers general duties to the employer (and self-employed) to persons other than their employees.

The angle was from the point of their duties and not the duties to them.

Luke - well they owe the same duties as any other employer (don't they?) i.e. in brief S2, S3, S4 (if applicable) S6 (if applicable) S9 etc etc!!!

Also - took a fantastic (in a really bad way) photo of a chap working at height the other day on a way to a site inspection. If you want it for presentations etc then PM me your email address (I have pixelated his face so no recognisable features).
