Would there be any legal implications from moving non hazardous waste from a restaurant and bar to a contractors licensed skip in his yard. The waste would be food, bottles, cardboard etc and would be transported using a vehicle with a waste carriers license. The contractors skip gets cleared and replaced by a new one by the external skip company they use. Thought ?

As most of the material sounds like it is recyclable would it not be easier to get a permit to use your local amenity site? I don't know what the costs are in England but in Scotland they are fairly reasonable and would be a lot less hassle. If you cannot do this then, depending on how pedantic your local inspectors are, the builders yard could actually be classed as a waste transfer station with all the resulting rules and regulations.

Thank you for the reply, The owner of the restaurant and bar is also the owner of the builders yard. Would this make any difference ?

I don't think it would matter if they were the same owner as it is still a transfer of waste from one site to another, you would only get an exemption for storage of waste on the site it is produced. The circumstances sound like a degree of common sense would be required from the local inspectors and if there was ever a neighbour complaint if they would follow it up. I would still look at recycling options if possible, if not give your local EA a call and take their advice.

Thanks again for the reply, I have just spoke to the EA and they have told me it's fine to go ahead as long as a waste transfer note is filled in each time.

I think you need to look at the guidance for exemptions from waste licensing. In recent years there have been some moves to exempt certain types of small scale waste production and storage from the full waste licensing regime (although not from the transport requirements) The activity you describe falls into the description given by the Enviornment Agency for "Temporary Storage of waste at a place controlled by the producer" See this link http://www.environment-a...ents/Business/NWFD_2.pdf
