The Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations

I have a feeling this may have been asked before but i would like peoples feedback if possible please.
I understand the The Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations 2007 have come into full effect now and that some companies are gtting fines for not conforming with the surveying of their Air Con units over 12kw at intervals of no greater than 5 years apart.
Apparently it has been a very grey area for the last couple of years with no one taking any real notice of this legislation.
The problem is we have two different contractors telling us two different things one is saying if they have had the installation done after 2008 then the survey will not need to be done until 5 years after the install date. as in if one was installed brand new in June 2009 a survey wouldnt be required until June 2014
But the other is saying the surveys are required regardless of age.
Could anyone clear this up for me please and give any more info or experience with local environmental officers picking up on this.

How does this affect H&S? This seems to be a planning and control thing. The legislation itself should be refered to to discover exactly what it says about the five year inspection.

Inspections of air-conditioning systems
21.—(1) It is the duty of the relevant person in relation to an air-conditioning system to which this Part applies to ensure that the system is inspected by an energy assessor at regular intervals not exceeding five years.
(2) The first inspection of the system must take place before the relevant date.
(3) In this regulation “the relevant date”—
(a)where the system is first put into service on or after 1st January 2008, means the last day of the period of five years beginning with the date on which the system is first put into service; and
(b)where paragraph (a) does not apply—
(I)in the case of a system with an effective rated output of more than 250kW, means 4th January 2009; or
(ii)in the case of a system with an effective rated output of more than 12kW, means 4th January 2011.

I got picked up for this on my Compliance audit, however this comes under the environmental umbrella. Contractors that service your air con units, you should have copies of their training certificates, and keep an F gas register of all your units. The contractors should fill out the record sheet and you should keep them on file. If you want copies of paper work then PM me, and I will send you copies of everything you need to be compliant

One connection re these regs and H&S is that many work places are now having increased noise and draught problems
The reason behind the above appears to be that many vent systems have not been looked at for years [irrespective of COSHH] and when they are many do not conform so people are having new units fitted/old units maintained properly etc and 'new' H&S problems are arising
In my view people are more concerned with complying with these regs than H&S regs especially so in kitchens where the EHO's are looking at ventilation and the local planning etc are more concerned with environmental areas than H&S areas - I think that such Env areas are more prominant in marketing as well as companies use compliance with energy saving/energy management etc as a sales tool
This is just another example of the Env areas V the H&S areas situation

Thanks Thus far for all the help guys, This is obviously an emotive subject but what i really want to know is..
Do all units/companies have to be compliant by Jan 4th this year or can the Air Con unit wait until it is 5 years old as in if you built a new store in 2010 with a brand new Air con unit over 12kw could that wait until 2015?
