Is there an actual legal requirement to service FE etc annually or within a set timescale or does this come from a BS? Section 16 of The Fire Safety (Scotland) Regulations 2006 does not state actual timescales nor can I see timescales discussed in the 2005 Act. In Scotland...

I'm looking for the point in law that refers one to guidance whether it be a BS or not - can you help?

OK I'll try again. There is not a legal requirement to service fire extinguishers annually. True or False.

Any comments?

I think you will find its a BS5306 that is normally followed as good practice and doubt you will find a defined timescale in the legislation.

I would suggest that any extension beyond 13 months (12 months +/- 1 month) for basic maintenance would have to be demonstrated by risk assessment taking into account The Management of Health and Safety at Work Regulations.

Garfield - you'll also probably find that your property insurers have applied a warranty or condition that FEA is maintained on an annual basis.

The liability insurers will have a similar requirement if you are doing any kind of hot work on client's premises.
