Afternoon all,

With regard to H class vacuum cleaners. The following statement is found in the HSE asbestos essentials note EM4.

"The hire company should thoroughly examine and test the cleaner at least once every six months.They need to be licensed by HSE to do this."

My question is where is the legal requirement found to carry out the examination and test and how do I find out if a company is licensed?

It's in CAR2006 IIRC.

HSE hold a list of all the various licence holder types:

The cleaning and maintenance of the Type H is covered by Regulation 2 of the Control of Asbestos Regulations 2006: the Approved Code of Practice L 143 (Work with materials containing asbestos) deals with this specific subject on page 8 - Ancillary Work.

You have not stated the reason for your question.

However if it is because you are thinking of hiring a Type "H" vacuum cleaner you must ask for a copy of the current DOP (Dioctyl-Phthalate) test certificate to come with the equipment.

This is the certificate of testing every six months that you mentioned.

The certificate should contain the following information:
Company carrying out the test
Unique certificate number
Description of equipment
Serial number
Date of Test
Date of retest
DOP test information
DOP results
Electrical results
Tested by, and Signature

Yes. That is the statutory requirement.

Regulation 12. Use of control measures.

Paragraph 209 and 210 "maintenance of vacuum cleaners"

A minor point, it my understanding that DOP (dioctyl phthalate) is no longer used since it is carcinogenic. DOP now conveniently stands for dispersed oil particulate.

It's also worth noting that H type vacuum cleaners are used extensively in the nuclear industry but the regulations are less specific and most users test their filters at one or two yearly intervals. Additionally, there is no requirement for testers to be licensed by the HSE.

I have always understood it to be dispersed oil particulate (DOP) test as well. If a type H vacuum was used in the nuclear industry for asbestos works, it must still be DOP tested 6 monthly but will not be taken out of a radiation controlled area for the testing.

Gerry D, perhaps I didn't make myself very clear. In the nuclear industry we use type H vacuum cleaners pretty much as standard for radioactive contamination control mostly for non-asbestos work and in that context the testers don't need to be HSE licence holders. For Radioactive contamination asbestos control, yes.
