Do Hi Vis waistcoats/vests have to comply with British/European standards to comply with the law? I have found no evidence in the PPE at Work Regs to suggest they do, however HSE guidance (which is just that) says ensure it meets the specified standards. If they are not designed and manufactured to a standard (BS EN 471) can they be supplied under the PPE regs by suppliers/manufacturers as items of PPE or do they just become colourful work wear?

EN471 Specification for High Visibility Clothing EN471:2003 (High-visibility warning clothing for professional use) EN471:1994 has been superceded by EN471: 2003 This revised standard is intended to encompass all previous 1994 requirements while allowing for more "Corporate" styling without reducing personal safety. For example; retro reflective tape can be positioned at angles +/- 20degrees. Garments tested to EN471: 1994 can continue to be sold, however any new designs must be tested to the revised standard. What you need to know There are 3 classes of garment type based on the levels on conspicuity they provide. On all garments the retro-reflective tape must not be less than 50mm wide. CLASS 3: Highest Level of conspicuity Minimum background material 0.8m2 Minimum Retro-reflective material 0.2m2 i.e. Jackets with sleeves to be worn in accordance with Clause 4.2.4 and to Class 3 on dual carriageway roads with a speed limit of 50mph or above CLASS 2 Minimum background material 0.5m2 Minimum Retro-reflective material 0.13m2 i.e. Arco code 1880500 2 Band & Brace Hi-vis waistcoat CLASS 1 Minimum background material 0.14m2 Minimum Retro-reflective material 0.10m2 i.e. Minimal risk such as off road activities. Hi-vis trousers will commonly meet this standard when worn separately from upper garments.

It's an interesting question that hasn't been answered yet. My quick search of L25 reveals no mention of 471. It would be good to see some more replies to see where the answer lies.

I think the 2002 Personal Protective Equipment Regs (different from the PPE at Work Regs) specify that any PPE has to comply with certain standards to be considered suitable, so could be those are the Regs you're looking for.

Ahhh the murky waters of conformity marking... European law and standards are more slippery than an eel in KY jelly, but I believe that this is the way it is intended to work... The regulations that control use, namely the Personal Protective Equipment at Work Regs. 1992 regulation 4(3)(e), requires PPE to comply with the regulations that control design, manufacture and supply, the Personal Protective Equipment Regs. 2002. Those supply regs require PPE to be CE marked to show conformity. One means that manufacturers can comply with the supply regs is to manufacture their PPE in accordance with a "harmonised standard". The harmonised standard for hi-vis is EN471:2003 + A1:2007 [i.e. including the 2007 amendments]. Manufacturers could comply with PPE Regs 2002 by working from first principles rather than EN471, but I don't know of any that have tried.
