Hi,
I wanted to canvas for an opinion on whether CDM apply's to a project within my company. We have recently bought a building which we will be fitting out to suit our purpose. There will be no structural changes to any load bearing walls, only changes to internal stud partioning, installation of additional power & comms including generators & UPS. There may be other internal works such as taking down & replacing internal ceilings, maybe some welface facilities upgrades/changes. The project will be tackled in a piece meal approach of getting the works done gradually over the coming months ready for the building to be occupied by the 2nd quarter of next year. We have internal project managers that can oversea this in conjunction with facilities team.

From what U describe CDM applies
It worries me where you say that you have internal people who may manage this area but they do not appear to know if CDM applies [U have asked them I suppose?]?

CDM applies to all projects. Is you question do you need a CDM-C and do you have to notify this to HSE

Everyone controlling site work has health and safety responsibilities. Checking that working conditions are healthy and safe before work begins, and ensuring that the proposed work is not going to put others at risk, require planning and organisation. This applies whatever the size of the site.

Mark, the key issue is whether the work you are doing meets the definition of construction under CDM; have a look and decide. If it does then CDM applies. Whether or not it needs to be notified and the additional duties thereafter is another matter.

Notification is required where construction work is expected to A. last more than 30 working days or B. involve more than 500 person days
CDM apply the principles to all project works (notifiable or not - if its notifiable a CDM C will be required). Where this would not be notifiable would be works for a domestic client.

Thanks, I probably wasn't clear in the original post, CDM applies, it's more whether or not it falls into the notifiable catergory and as such CDM co-ordinator/planning supervisor etc come into the equation. I think Phil has knocked it on the head, it's whether it meets the definition of construction in it's entirity.

Allen29883, Gary s is quite right. The full content of the CDM regs 2007 will apply to this project. The full guidance for these regulations, with explanations, can be downloaded from the HSE website for free. The document is the approved code of practice L144. Seeing as your project will be running, in effect, until the 2nd quarter of next year, you will be exceeding the 30 days quota of the CDM regs.

Just to add to Gary Ss' reply, the 30 working days don't need to be consecutive, if the total amount of worked days is over 30, then it becomes notifiable. Working days only include weekends if work is done on-site during the weekend.
