What a bizarre headline. How can you determine negligence without bringing a court case, i.e. suing?

If I may indulge in a bit of rhetoric: is the professor suggesting a ban on civil claims, or is it the Mail being silly?

I think I'll wait until Monday for the full report rather than relying on a press currently under scrutiny by Lord Leveson for making stuff up.

I'm just waiting for the first mail readers head to explode. A foreigner casting doubt on our legal system (developed over centuries) while having a go at 'elf n safety'. Kabooom......
