I've received a cold call from a company claiming that it is a legal requirement to have air conditioning with a total power of 12 kW or above inspected by an independent, accredited engineer (which they would be only too happy to provide). When I challenged them to name the legislation they first said "TM44" and then "the European Energy Performance of Buildings Directive" but were unable to name any UK legislation. Is there any truth in the claim that this is a legal requirement in the UK or are they trying it on?

The Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations 2007 enacts the relevant Article of the Energy Performance of Buildings Directive and require inspection of all air conditioning systems with rated outputs over 12 kW at intervals not greater than 5 years. Those over 12kW must be inspected by 4 January 2011 and the work must be carried out by an accredited inspector. The inspection is for the purposes of energy efficiency of course, not H&S. The legislation seems to be little-known, a sad result of lack of publicity and information for building owners / managers. Sad, because all the rest of us would also benefit from more efficient energy consumption by these plants.

That's very helpful, thankyou. On looking at the text of the regs mentioned by tomorton, this only applies if there is a total of 12 kW of air conditioning in a single building. So in the case of small air conditioning units scattered across different buildings on the same site, presumably it won't apply.

Yes Kate, as I understand it the requirement is specific to individual buildings, not aggregated on the site.
