Happy New Year Any views would be gratefully received – thanks. (Office Dispute!) Member of staff trips and falls over (on our property, cause can be identified – trailing wire). Suffers grazes and bleeding to both knees, knees start to bruise and become worse as time progresses and, by the following morning, are very swollen and painful. Injured person goes off-sick for more than three days. RIDDOR-reportable so far....however, employee has rheumatoid arthritis and believes that the fall aggravated this condition. Might not have gone off sick as a result of the fall had it not been for the pre-existing condition. Question: Is the incident still reportable? Does the fact that someone has an existing medical/physical condition/injury negate the need to report under RIDDOR, if an accident aggravates the existing condition? Many thanks, Mike

I would be inclined to report it as you cannot be certain that the fall did not aggravate the condition - unless you are a specialist doctor of course. Also, and probably goes without saying, log a first aid incident and carry out an investigation to prevent re-occurence of this and any other similar incident

I too would report it. Mainly because you are reporting the facts of an Injury on the date concerned. I would however mention the medical condition in any other investigation reports and to the LA if necessary.

Incident work-related. Resulted in over three day injury. Reportable.

Pssst bob, wrong posting. But to this topic shows there is some very clear advice being given. You must forget about any condition that existed and simple report the accident. The other conditionis rathe imaterial as the accident itself may have caused the condition to worsen but that is an other aspect of any claim for injury. RIDDOR is simply about reporting the accident and nothing to do with any follow up investgation or claim.

Thanks for this folks My personal view was/still is that the accident is RIDDOR-reportable; there is clear cause (the trailing wire) and the person did suffer a personal injury as a result of the fall. I will be mentioning the pre-existing medical condition on the F2508 as I would mention any “mitigating circumstances” when reporting under RIDDOR. (It would, of course, also be something to bring up if we were to receive a personal injury claim.) The “dispute” arose when I was carrying out an audit of accident reports within our Group and found that this hadn’t been reported; my questioning about why the F2508 hadn’t been completed led to some debate within my Team! (So far as the “trailing wires” are concerned, in the injured person’s “defence”, they were in a garden and partly obscured by grass/weeds and visibility wasn’t great, however, the person was using a mobile phone at the time and not fully paying attention to where they were walking.
