Although I'm not aware of the full facts of this sad case, this appears to be one where there are no winners. However, the officers' Fire Chief has openly criticised the decision by the CPS to prosecute the officers - following a not guilty verdict. I have to say the decision to prosecute by the CPS was a surprise. Moreover, the CPS seem to be muddying the waters as they did with the prosecution of Lords Condon and Stevens following the fatality of a police officer who fell off a roof whilst chasing a suspect. In this case the Judge criticised the CPS for bring the prosecution. http://www.shponline.co....fter-not-guilty-verdicts I do support the Fire Chief in asking for an investigation into the decision to prosecute the fire officers. One officer was earlier acquitted on the direction of the judge. Fire fighting is a dangerous activity, we do not want a situation where commanders on the ground prevaricate because of fear of prosecution. Fire fighting is also a dynamic situation where the normal process of risk assessment does not readily lend itself - decisions have to be made on the spot. Meanwhile, I fail to understand why with nearly 1000 workplace fatalities that the CPS have only prosecuted two organisations for Corporate Manslaughter since the Act came into in force four years ago. Individual directors rarely get prosecuted for manslaughter either and many 'Phoenix' companies go into voluntary liquidation to avoid prosecution. Surely, these are the issues which should be given priority?
